By accessing the Site or using the Services in any manner, you acknowledge that you have read and understood the following terms and you agree to be bound by them. You acknowledge that these Terms constitute a binding and enforceable legal contract between you and us which further enforces class action waiver and arbitration provisions as detailed below in the dispute resolution section. 1. Eligibility and Age Limitation

You further represent that you are of legal competence to enter into these Terms and you are: (i) at least thirteen (13) years of age if located in the US; (ii) at least sixteen (16) years of age if located in the EU; or (iii) above the age defined as “child” under applicable laws in your jurisdiction if located elsewhere. Proof of age may be requested.

6. User Generated Content

Users must have the rights to submit UGC and it must not violate laws, include unlawful or harmful content, or infringe on third-party rights. By submitting UGC, users grant Kinetix Media and other users worldwide, non-exclusive, royalty-free licenses to use, display, distribute, and create derivative works from the UGC. Kinetix Media may monitor, censor, edit, or remove UGC at its discretion.

7. Copyrighted Information and Content Policy

Users may not submit proprietary information of third parties. Copyright infringement notices should be sent to partners@kinetix.tv and must include sufficient details for Kinetix Media to investigate. Users must consider fair use or similar exceptions before submitting claims.

8. Unlawful Usage

Disputes should first be attempted to resolve informally. If unresolved, binding arbitration under ICC ADR Rules will apply in English, in London, UK. Users waive rights to jury trials and class actions unless opting out with written notice. Terms are governed by laws of London and Wales.

14. General

These Terms do not create partnerships or employment relationships. Unenforceable provisions are severable. Users may not assign rights without written consent. Headings are for convenience only. Terms supersede prior agreements.

15. Prohibited Content

Users may not upload content that is unlawful, harmful, adult, deceptive, or violates intellectual property or consumer laws. Kinetix Media may monitor and remove prohibited content.
